Martinsville police say Indiana mask mandate ‘not enforceable’ by officers
Attorney General Curtis Hill said the statewide mask mandate should be debated by legislators, not enacted by an executive order.
INDIANAPOLIS — The state’s attorney general and a local police department are calling out Governor Eric Holcomb for his plan to charge people who violate the state’s impending mask mandate with a crime.
Governor Eric Holcomb announced Wednesday a statewide mask requirement would take effect in Indiana on Monday, July 27. Those who don’t follow the order would be charged with a Class B misdemeanor.
During his briefing Wednesday, Holcomb said the state would continue to approach the pandemic and the mask mandate as an act of education and “appealing to one’s civic duty and public good. You might even say public pride and being part of the solution and it will continue to be.”
Holcomb said while not wearing a mask would be considered a misdemeanor infraction, “the mask police will not be patrolling Hoosier streets.”

But Attorney General Curtis Hill said the mandate should be debated in a special legislative session at the Indiana Statehouse, not through the executive order Holcomb is expected to sign.
“The wisdom of wearing masks — or of laws requiring such measures — is not the issue here. Rather, the issue is whether we are following the proper and constitutional processes for enacting laws and whether we are respecting the distinct roles of each branch of state government,” Hill said.
